Highway Hand Terms & Conditions
Highway Hand provides a technology platform, whether through mobile app or website, allowing its users to request roadside assistance from other users. At the same time, users can use the same platform to provide roadside assistance to others. Following section describes the terms and agreements on which Highway Hand, Inc. offers access to its website and mobile app.
HIGHWAY HAND DOES NOT PROVIDE ROADSIDE ASSISTANCE SERVICES. IT IS UP TO THE USERS, BOTH PROVIDING OR REQUESTING, ROADSIDE ASSISTANCE TO CHOOSE WHETHER TO REQUEST OR PROVIDE ROADSIDE ASSISTANCE TO OTHER USERS. HIGHWAY HAND ONLY HELPS MATCH USERS IN NEED OF ROADSIDE ASSISTANCE WITH THOSE USERS THAT ARE WILLING TO PROVIDE ROADSIDE ASSISTANCE. FURTHERMORE, HIGHWAY HAND DOES NOT DO ANY DUE DILIGENCE TO ASSERTAIN THE VALIDITY OF INFORMATION PROVIDED BY EACH USER OR ANY USER INFORMATION COLLECTED THROUGH THE HIGHWAY HAND PLATFORM. HIGHWAY HAND IS NOT RESPONSIBLE FOR ANY LAPSE IN QUALITY AND COMPLETENESS OF SERVICES PROVIDED BY ITS USERS OR THE BEHAVIOR OF ANY OF ITS USERS. HIGHWAY HAND IS NOT RESPONSIBLE FOR ANY LIABILITY ARRISING FROM THE ROADSIDE ASSISTANCE SERVICES PROVIDED BY THE USERS OF THE HIGHWAY HAND PLATFORM.
By signing up as a user and using the Highway Hand platform you explicitly agree to, and accept, all terms stated within this agreement. Furthermore, Highway Hand reserves the right to modify, replace or make any changes necessary to this agreement whereby the continuous use of the highway hand platform by any of its users will construe as an agreement to any changes made herein, at any time.
Users must be at least 18 years of age to create and use an account through the highway Hand platform. Any user below the age of 18 shall not use the Highway Hand platform.
Users must submit certain personal information to create an account, such as telephone number, email, name, payment method, etc. all of which is users’ responsibility to maintain. It is the users’ responsibility that all the information is accurate and up to date as Highway Hand has no ability or mechanisms in place to scrutinize its legitimacy. A User may not use false information or impersonate any person or entity. Users may be asked for any other information, at any point in time, to validate accounts and proof of identity and it is the user’s responsibility to comply.
Furthermore, by using Highway Hand platform, the user agrees to the following:
User will abide by all laws applicable in any State or territory within the United States of America.
Users shall not use the highway Hand platform for any other reason besides what the platform is built to do.
User possess a valid driver’s license.
User is solely responsible for any liability that results from requesting or providing roadside assistance services, while using the Highway Hand platform.
Users agrees to abide by all requirements pertaining to tow trucks, roadside assistance services and department of motor vehicles rules and regulations.
User agrees to do his or her own due diligence when selecting who to assist or request roadside assistance from and to make sure all information shared within Highway Hand platform is correct.
Users agree not to defraud, harass or conduct any wrongful and illegal acts through the use of highway Hand platform or any information shared within.
Users agree to let Highway Hand share all necessary information, such as Name, telephone, location, etc. with other users when requesting or providing roadside assistance services through the highway Hand platform.
Users that sign on as ‘roadside assistance provider’ businesses shall adhere to all rules and regulations, including any tow truck licenses, business licenses, liability and or insurance requirements as per the rule of law. As with any users, these tow truck service providers shall use the Highway Hand platform to acquire customers with the intention of providing roadside assistance services. Furthermore, all information and credentials should be maintained by these businesses at all time without any misrepresentation of any information provided to or shared with Highway Hand and its users.
If a User agrees to provide roadside assistance services to another user, or request roadside assistance services from another user who has entered a Dollar amount as a cost/reward for their services, through the Highway Hand app, the user agrees to provide a valid form of payment which highway Hand shall store and maintain through a third party secured payment services provider known as STRIPE.
Highway Hand shall not store any information pertaining to payment information on its servers and instead transfer it directly to STRIPE.
Highway Hand, through the use of third party vendor – STRIPE, make the necessary dollar amount reductions from users requesting roadside assistance.
Highway Hand reserves the right to revise any charges for services received through the Highway Hand platform.
In case of a dispute, Highway Hand shall adjudicate to the best of its ability and make charges or remove payments as per the outcome of the arbitration.
Highway Hand only provides for a platform to help those that require roadside assistance locate, and to some extent communicate, with those providing roadside assistance services. Highway Hand does not hire, contract or in any way employ any of the roadside assistance providers listed on the highway Hand platform. Highway Hand provides its services “as is” without any warranty or guarantee. Highway Hand does not warrant the legitimacy, accuracy and quality of services provided by the Highway Hand users through the Highway Hand platform. Any liability or lapse in quality or completion of services, arising from proving roadside assistance services, is entirely the responsibility of the users providing those services through the highway Hand platform.
Highway Hand does not warrant the safety, quality, completion or efficiency of the services provided by the users (Roadside Assistance providers). It is the responsibility of the user requesting the services to fully vet and ultimately deal with the final service provider. Highway Hand does not guarantee the accuracy of information provided by each user. Highway Hand is not responsible for the conduct, at any time, of any of its users. Highway Hand is not responsible for any information that is disclosed through the Highway Hand platform to other users, such as at name and phone number at the time of requesting roadside assistance services.
